Privacy Policy for Pivot

This Privacy Policy explains how Pivot Studio Inc (“Company,” “we,” “us”) collects, uses, discloses, and otherwise processes personal data on behalf of our customers, typically merchants (each, a “Merchant”), in connection with our application Pivot, which operates on the Clover® Point of Sale platform (“Clover POS”).


This Privacy Policy applies only to personal data processed through the use of the Pivot application on Clover POS and does not apply to any other products, services, or business activities of Pivot Studio Inc.


Our processing of personal data is governed by this Privacy Policy and our agreements with Merchants. In the event of a conflict between this Privacy Policy and a Merchant agreement, the Merchant agreement will control to the extent permitted by applicable law.


This Privacy Policy does not replace any privacy notice that a Merchant may be required to provide to its customers, employees, contractors, or other individuals.


1. Information We Collect

Pivot processes personal data solely on behalf of Merchants, who determine the scope and purpose of the data transferred to us. The categories of personal data we process depend on the Merchant’s configuration of Clover POS and the features enabled.


A. Transaction Information

When a customer completes a payment using Clover POS, we may process transaction-related information, including:

  • Payment method type (e.g., card brand or tender type; no full payment card numbers are stored)
  • Name associated with the payment method, if provided
  • Merchant location
  • Date and time of the transaction
  • Transaction amount
  • High-level information about the goods or services purchased


Pivot does not store sensitive authentication data such as full card numbers, CVV codes, or PINs.


B. Additional Information Provided by Customers Ancillary to Payment

We may process additional information provided by customers through Clover POS, including:

  • Email address or phone number (e.g., for electronic receipts)
  • Customer marketing preferences, where enabled by the Merchant
  • Loyalty or rewards program participation details
  • Delivery-related information such as physical address, where applicable
  • Voluntary information provided by the customer, including feedback, reviews, or preferences


C. Information About Merchant Personnel

We may process information related to Merchant personnel interactions with Clover POS, including:

  • Employee identifiers (e.g., name or employee ID)
  • Clock-in and clock-out times
  • Tips earned
  • Role-based permissions and shift-related data


D. Information Provided Directly by Merchants

Merchants may provide additional data directly to Pivot or grant Pivot access to such data through Clover POS, including:

  • Customer contact information (e.g., email address, phone number)
  • Purchase and transaction history
  • Employee scheduling, shift assignments, and sales performance data


2. How We Use the Information

Pivot uses personal data only to provide and operate the Pivot application on behalf of Merchants, including to:

  • Enable labor management, scheduling, and payroll-related functionality
  • Provide real-time operational insights based on transaction and staffing data
  • Generate reports and analytics for Merchant operational use
  • Support integrations with Clover POS features as authorized by the Merchant


We may also use personal data for limited internal purposes, including:

  • Communicating application updates, service notices, and security alerts
  • Monitoring performance and improving application functionality
  • Providing customer and technical support
  • Detecting, preventing, and addressing security, fraud, or technical issues


Additionally, Pivot Studio Inc may process personal data where necessary to:

  • Comply with applicable laws, regulations, and lawful requests
  • Enforce contractual terms governing the Pivot application
  • Protect the rights, privacy, safety, or property of Pivot Studio Inc, Merchants, or others
  • Investigate and prevent fraudulent, unauthorized, or unlawful activity


3. How We Share Information

We may share personal data only as necessary and as permitted by applicable law, including with:

  • The Merchant on whose behalf the data is processed

  • Third parties as explicitly directed or authorized by the Merchant
  • Trusted third-party service providers that support hosting, analytics, security, or customer support, under contractual confidentiality obligations
  • Corporate affiliates of Pivot Studio Inc, solely for purposes consistent with this Privacy Policy


We may also disclose personal data if required to comply with legal obligations or to protect against fraud, security threats, or harm.


In the event of a merger, acquisition, reorganization, sale of assets, or similar business transaction, personal data may be transferred as part of that transaction, subject to reasonable safeguards and continued compliance with this Privacy Policy.


4. Data Retention

Pivot retains personal data only for as long as necessary to provide the Pivot application and fulfill contractual obligations with Merchants, unless a longer retention period is required or permitted by law.


5. Data Subject Rights

To the extent applicable law provides individuals with rights regarding their personal data (including access, correction, deletion, or restriction of processing), requests should be directed to the Merchant, who acts as the data controller.

Pivot Studio Inc will assist Merchants or Clover in responding to such requests in accordance with applicable agreements and legal obligations.
